§ 5 University council (as per articles of association, section 3)

(1) As the University Council of the Music and Arts University of the City of Vienna, the supervisory board of Music and Arts University of the City of Vienna GmbH acts without any members of the private university. The University Council consists of four to six members, appointed by the general assembly. The Senate appoints half of the members of the University Council (i.e. they have a right to nominate two or three members). The members nominated by the Senate are appointed by the general assembly. People are considered if they can contribute to achieving the objectives and responsibilities of the Music and Arts University of the City of Vienna on the basis of their outstanding abilities and experience.

(2) The term of office and the duties of the University Council are regulated in the rules of procedure of the supervisory board of Music and Arts University of the City of Vienna GmbH. The retraction of the appointment as a member of the University Council or the premature resignation of a member of the University Council follows the stipulations applicable to the supervisory board of Music and Arts University of the City of Vienna GmbH, especially the GmbHG (Austrian Limited Liability Companies Act). If a senate-appointed member withdraws from the University Council before the end of the term of office, the Senate has the right to nominate a replacement member within a reasonable period of time.

(3) The members of the University Council must not be members of the Music and Arts University of the City of Vienna.

(4) Membership of the supervisory board of Music and Arts University of the City of Vienna GmbH precludes membership of the other organs, the Studies and Research Commissions and the Task Force for Equal Treatment Issues of the Music and Arts University of the City of Vienna.

(5) The vice-chancellor’s office, the chairperson of the Senate and the chairperson of the Students' Representative Council of the Private University have the right to be heard in the meetings of the University Council regarding agenda items that affect their area of responsibility.

(6) The University Council establishes its own rules of procedure (see also the rules of procedure of the supervisory board of Music and Arts University of the City of Vienna GmbH) and approves the rules of procedure of the vice-chancellor’s office.

(7) The University Council, having regard to the opinion of the Senate, provides a position statement on the drafts for objective and performance agreements (medium-term planning) to be submitted by the vice-chancellor’s office.

(8) The University Council is responsible for approving proposals to amend the articles of association and for passing resolutions about any matters that are submitted to it by the vice-chancellor’s office.

(9) The University Council is responsible for approving the central regulations (such as the PhD regulation, appointment regulation, electoral regulations) of the Music and Arts University of the City of Vienna at the suggestion of the vice-chancellor’s office.

(10) The University Council is responsible for establishing or discontinuing study programmes and courses, which must be approved by the Agency for Quality Assurance and Accreditation Austria.

(11) The members of the University Council are obligated to take the relevant care during their activities and are not bound by any instructions or directions when carrying out their university duties.
